A special public prosecutor representing the Delhi Police in a case relating to the 2020 North-East Delhi riots was pulled up by a Delhi Court on Wednesday. The prosecutor’s conduct was called into question after he threw files in the court and showed aggression. The Commissioner of Delhi Police Sanjay Arora was directed by Additional Sessions Judge Pulastya Pramachala to evaluate the situation, stating that “it is ultimately a matter of how the prosecution is represented.” The court also instructed the District & Sessions Judge (Northeast) of Karkardooma Courts to inform the judge of the prosecutor’s behaviour.

The judge warned the prosecutor to desist from showing any kind of aggression before the court and to be much more careful in maintaining decorum. The development ensued in FIR 98 of 2020 registered at Bhajanpura police station, alleging that a mob assaulted a head constable during the violence, resulting in grievous injury. In January, Abdul Sattar, Mohd. Khalid, Hunain, Tanveer, and Aarif were charged with rioting and unlawful assembly by the judge.

During the examination of the first prosecution witness, the judge stopped the process as the prosecutor came up with leading questions and probable answers. The prosecutor was given a warning twice to desist from such practice. Before the court could make its observation, the prosecutor lost his cool and started shouting that the court was not seeking answers from the witness. The judge observed that with such an approach of the prosecutor, it shall not be an easy task to conduct further proceedings in the case. 

The judge also said that he did not find the conduct of the prosecutor to be very professional. The court warned the prosecutor to avoid showing any aggression in the court and throwing files. The court considered this conduct unprofessional and suggested that any aggrieved party is always at liberty to take legal remedies before a higher forum rather than showing any aggression and throwing files in the court. SPP Rajeev Krishan Sharma appeared for Delhi Police, while Advocates Saiful Islam, Mohd. Dilshad and Abdul Gaffar appeared for the accused Abdul Sattar, Hunain, and Tanveer, respectively.
