While initially allowing the petitioners to approach the Chief Justice of Allahabad High Court for an urgent hearing of the matter, the bench made up of CJI DY Chandrachud, Justice JB Pardiwala, and Justice Manoj Misra decided to list the matter for Aug. 16 instead. The petition challenges the railway authorities’ demolition drive intended to clear encroachments in the backyard of Sri Krishna Janam Bhoomi in Mathura.
This is in opposition to a planned demolition drive at Krishna Janam Bhoomi, senior attorney Prashanto Chandra Sen explained in his Monday afternoon request to the bench for an expedited listing of the matter. Sadly, all courts in UP have been closed today due to the shooting of a lawyer. The High Court and the District Courts are therefore both closed. All I’m asking is for the plea to be included today.
The CJI initially suggested that the petitioners approach the High Court before allowing them the freedom to approach the Chief Justice of the Allahabad High Court for an urgent listing of the matter. But as the court was getting ready to adjourn for the day, Sen reiterated his petition and brought the subject back before the bench.

The CJI then announced that he would place the matter before a suitable bench the following Wednesday. The railroads authorities recently conducted a significant demolition operation in Mathura’s backyard to remove alleged encroachments in coordination with the local police and government. The majority of the buildings in the neighbourhood are houses. According to the railroads’ public relations officer (PRO), the claimed encroachments were removed as part of a plan to change the current metre gauge railway track into a broad gauge track, facilitating a connection between Mathura and Vrindavan.
In the beginning, the petitioner had filed a civil lawsuit before the civil Court Senior division, Mathura, seeking a permanent injunction against the railway authority. While this was happening, demolition work started on August 9, 2023. A request for a temporary stay was immediately filed after this was once more contested.
The Bar Council approved a resolution due to the killing of an advocate, which prevented Allahabad courts from holding court on August 14, 2023, so the petitioners were unable to access them. The Railway Authority was accused of starting the process of demolishing homes while the Supreme Court was hearing the case. The petitioners were thus left with no choice but to file a case with the Supreme Court.
