Allahabad High Court quashed a rape case titled Shivam Kumar Pal v State & Ors noting that false first information report (FIR) was lodged in the case. The Court imposed costs of ₹10,000 on the woman while quashing the case, urging that stern action must be taken against the increasing trend of false rape cases.

A Bench of Justice Anjani Kumar Mishra and Justice Vivek Kumar Singh ruled that the criminal justice system cannot be used to settle personal scores. Shivam Kumar Pal, accused of rape, breach of trust, and criminal intimidation, argued that the FIR was fabricated and concocted. The accused and complainant’s counsel agreed with the accused’s submission, stating that they are happily living together as husband and wife on their own free will.

Hence, the Court quashed the case and imposed costs of ₹10,000 on the woman, who admitted the FIR is false. The court opined that the FIR was lodged to pressurize the petitioner and settle scores, and the court quashed the case. Thus, imposing costs on the woman.
