An activist social worker named “Razia Khan” was the appellant in 1992. The Directorate of Women and Child Development’s office in Bhopal was assaulted by her. The cop suffered a right finger injury as a result of her harassment and assault on him during a meeting of public authorities.In the session court, a lawsuit was subsequently filed over it. The court sentenced the appellant to one year in jail for assault and trespass and two years in prison for inflicting great bodily harm to a public official, in accordance with sections 333, 353, and 451 of the penal code.
The case was then brought before the high court by appellant “Razia Khan”. Her punishment for the offence is lowered by the court to six months. Furthermore, the appellant had submitted a plea to the SC. Her sentence was reduced to one month by the “Justices Abhay S. Oka and Justice Sanjay Karol” on the bench.And the court held that “Considering the circumstances set out, we are of the view that the appellant deserves to be shown leniency when it comes to the shown leniency when it comes to the substantive sentence. The distinct factors taken individually, do not constitute a ground by itself to show leniency.For example, only because an accused is on bail for a long time, it is no ground by itself to show leniency. It is only one of the several factors to be considered. But we have considered these factors cumulatively. Hence, we propose to bring down the sentence of the appellant for the offence punishable under Section 333 to simple imprisonment for one month”.[1]
(Due to the ongoing nature of the case the supreme court showed leniency and reduced the sentence because the matter was about of 30 years and the lady was 62 years old now but the sc stated if anything such takes place a 10 year long jail would be the ultimatum as assaulting a public servant is a grave violation.)
