Before the matter was heard by the constitutional bench the same matter was heard by three judges bench in the Supreme Court and the bench had observed that the separate endorsement in the LMV is not required if the vehicle weighs below 7500 kilograms ( unladen ) for transportation. However the matter was referred to constitutional bench. One of the Advocate for Petitioners argued that the definition of “light motor vehicle” has lead to this issue. He further stated a precedent which dealt with section 3 of the MV Act.
Further the five judges bench issued a notice to Union Government asking whether a person holding a Light Motor Vehicle license can drive transport vehicle of Light Motor which has unladen weight not exceeding 7500kilogrames with the same license. The bench asked the Attorney General for India to assist the matter. The matter is now listed for 13 September 2023.
