A Public Interest Litigation (PIL) was filed asking the authorities to promptly make the toilet block at Thumboormozhi Butterfly Garden and the toilet block should be functioning as well as accessible for visiting tourists. This PIL was dismissed by the Kerala High Court.
In addition, Sunil Kumar Karapattom’s PIL, it was requested that the relevant authorities be held accountable for their actions and that a comprehensive investigation be carried out into the carelessness and indifference demonstrated by the absence of basic amenities at the mentioned tourist location.
The Kerala Housing Board Corporation, which is the third respondent, has filed a counter-affidavit dated 18.10.2023 and an additional counter-affidavit dated 28.10.2023 in response to the notice and order issued by the court. The Assistant Secretary and Liaison Officer of the Third Respondent have explicitly declared in the additional counter-affidavit that the toilets are operational once again.
Despite the filing of these affidavits, the petitioner’s advocate argued that the toilets are only open temporarily. He therefore asked for this case to be kept on hold while.
The Division Bench of Chief Justice A. J. Desai and Justice V.G. Arun did not want to keep this case open in the absence of any evidence proving that the restrooms were only open temporarily.
Nonetheless, the Court clarifies that representatives of the respondents will visit the Garden regularly to make sure the restrooms are operational.
