
The Supreme Court on Monday asked the Council of Bar Associations of India (BCI) to submit a report detailing the measures taken by state bar associations in the past year against lawyers who have gone on strike or not out of court.
It would also include the ongoing strike observed by the members of the Delhi High Court Bar Association against the latest news that Justice Gaurang Kanth has been referred to the Calcutta High Court.
A bench of Justices Sanjay Kishan Kaul and Sudhanshu Dhulia observed this while hearing a contempt petition filed by an NGO, Common Cause . The court noted that advocates cannot halt the court proceedings and the justice delivery system.
In 2019 it was submitted that the BCI was not enforcing its own resolutions nor looking into the need for disciplinary action.
In December last year as well, the court qustioned the BCI so as to why it could not deter lawyers from going on strike.
