SUPREME COURT STAYS HC VERDICT QUASHING ELECTION VICTORY OF LONE LOK SABHA AIADMK MP: P RABINDRANATH KUMAR

In the case of, P. Ravindranath Vs. P. Milany & Ors. the Supreme Court stayed a Madras High Court ruling which had quashed the 2019 election of Theni Lok Sabha – Mr. P Ravindranath Kumar (MP) who is a member of All India Dravida Munnetra Kazhagam (AAIADMK) MP from Tamil Nadu. A bench of Justices Surya Kant and Dipankar Datta issued a notice in this matter and the next hearing of the case will be held on October 4, 2023. 

Senior Advocates Mr. K.K. Venugopal, Mr. Kapil SibalMr. Jayant Bhushan, and other advocates like Mr. Sharan Thakur, Mr. Ketan Paul, and Mr. Avi Tandon have appeared for Mr. Kumar. Whereas, Senior Advocate Mr. Neeraj Kishan Kaul with advocate Mr. Kartik Seth appeared for the complainant, Mr. P. Milany, on caveat. The party leader approached the Supreme Court and challenged the Madras High Court order of last month in the court during the proceedings. The High Court had set aside the general assembly election in 2019.

The petitioner Mr. Kumar was the only candidate who belongs to the AIADMK-NDA alliance and he won the 2019 Lok Sabha election in Tamil Nadu. Whereas, the DMK-led alliance had won the remaining 38 of the 39 seats in the election. On July 6 ruling, held that the petitioner suppressed his income in the election where the affidavit and his nomination were accepted by them. The High Court put the stay on the operation on the order for a month to allow the petitioner to file an appeal before the Supreme Court. 

In the High Court, Mr. Milany alleged that the petitioner suppressed his assets and liabilities and he claimed that Mr. Kumar was indulged in corrupt practices for votes. He accused Mr. Kumar that he has only disclosed his agriculture and business as his income sources, and he excluded the money that he had received from other sources. But in the court, he failed to establish his allegations of bribery and corruption on Mr. Kumar. Then, the judge refused to accept Mr. Kumar’s argument where he was alleged suppressing the information from the Court.
