The Rajasthan High Court has directed the state government to submit details about the curriculum, mode of selection and appointment of the staff, and control and management of madrasas in the state. The court has also sought a reply on the religious education being imparted through these madrasas.

The court’s order comes after a petition was filed by Mukesh Jain, who challenged the constitutionality of the Rajasthan Madarsa Board Act, 2020. Jain argued that the Act violated the basic spirit of the Indian Constitution, which terms India as a secular federal republic.

In its order, the court said that it was “necessary to know the details of the curriculum being followed in madrasas, the mode of selection and appointment of the staff, and the control and management of these institutions.” The court also said that it was “important to know the nature of religious education being imparted through these madrasas.”

The court has given the state government four weeks to submit the details. The matter will be heard again on September 1.

Here are some of the key points of the court’s order:

The court’s order is a significant development in the ongoing debate about the role of madrasas in India. The order will be closely watched by all stakeholders, including the government, madrasas, and the public.
