
A cleaner at a Delhi school has been charged with sexual abuse of a three-year-old child. The Delhi High Court was informed of the criminal charges on Friday. The local administration has announced a zero-tolerance policy for such incidents. The Delhi government’s attorney informed the court that an FIR had been filed under several sections of the Indian Penal Code and the Protection of Children from Sexual Offenses Act. The investigation is ongoing, and a charge sheet will be submitted soon. The incident took place at a school in Panchsheel Enclave, south of Delhi, and the court was considering a PIL it had initiated after the tragedy. Santosh Kumar Tripathi, a lawyer for the Delhi government, has called for the creation of a permanent child safety monitoring committee to ensure schools comply with the requirements set by authorities. He said they are required to visit every school in the city and verify that the checklist is followed. “It is necessary to establish a permanent kid safety monitoring committee. This situation shouldn’t have occurred,” he added.
During a hearing, the bench suggested the name of a retired judge for the committee, and Justice Sanjeev Narula requested that Tripathi provide the details of officials and independent individuals who could be nominated to the committee. Tripathi urged the court to issue an order to establish the committee. During the recent incident, he stated that a charge sheet was filed against a cleaner, and the CCTV footage was sent to the forensic lab for examination.
Arun Panwar, an attorney, also spoke on behalf of the Delhi government. The SHO mentioned in a status report that the accused was taken into custody on August 3 and sent to jail. The report stated that “the draft challan drafted against him under sections 376/376AB/377/376C IPC and sections 6/10/12 POCSO Act.”
The Directorate of Education (DoE) stated in the status report that it has issued several circulars and guidelines to schools regarding the safety measures and security of pupils, including the organization of awareness camps. The report emphasized that the DoE and GNCTD have a zero-tolerance policy towards child sexual abuse, sexual harassment, or any other issues related to the safety and security of the students of the schools. The DoE stated that the accused’s employment had been terminated and that all school employees must undergo police verification. According to the DoE, the school violated the safety regulations, and as a result, it has been given a show-cause notice.
The impacted schools must ensure that they adhere to any instructions given by the Department of Education or any law enforcement agency on the safety and security of the students enrolled in their respective schools. According to the status report, it appears that the school did not follow rules and regulations after analyzing the facts of the current instance. The status report states that to protect students’ safety, government schools now have CCTV.
The Department of Education has installed CCTVs in 651 of the 728 school buildings. Although live CCTV broadcasting has not yet started, the high court took immediate note of the incident involving the alleged sexual assault of the 3-year-old schoolgirl on August 8 and ordered that a public interest case be launched on that basis.
