The SC refused to grant interim relief to Bihar-based Youtuber Manish Kashyap, Kashyap was arrested by EOU ( Economic Offences Unit) of Bihar Police on March 18 and was transit remanded to Madurai and detained under National Security Act(NSA) by Tamil Nadu Police.
Last month a video on attacks on Bihar-based migrant video was made viral on the internet and the alleged Youtuber is one of the people who shared that video. Later, the video was declared fake by the officials, but it caused a great stir in the labour unions and the state as a whole. M.K Stalin, Tamil Nadu,s Chief Minister visited factories and provided helpline numbers for reporting any such issues and assuring the workers of their safety and awareness sessions were held in various districts in regards to the foundation of the video. The state Police reported cases against those who are found sharing the fake video.
Kashyap was ordered judicial custody for 15 days by Madurai District Court on 4th April, therefore when this matter was presented before the division bench comprising of CJI Chndrachud and Justice Pardiwala they remarked that “ How can we grant interim relief if he is in custody, come on Monday we haven’t read the papers…”.
Concerning the video another bench of the apex court granted anticipatory bail to UP’s BJP spokesperson and advocate. He is required to appear before police for 15 days and to seek an unconditional apology for his tweets relating to the said video.
