
- The three Afghan residents were booked under Sections 7 and 14 of the Foreigners Act, 1946, and Section 188 of the Indian Penal Code (IPC) for overstaying after the expiry of their visas and passports.
- They had already been in custody for over two years, and the trial was progressing at a slow pace.
- The High Court observed that the accused persons had no criminal antecedents and were not a flight risk.
- It granted them regular bail on the condition that they would appear before the trial court on all scheduled dates and would not tamper with the evidence.
The bail order was passed by Justice Anoop Chitkara on July 6, 2023.
