No vacations for children above 14 years of age: Kerala High Court

The Kerala high court on Tuesday stays the impugned order of the Kerala government saying to have vacations for children above 14 years of age. According to the court, the vacation classes must be arranged as they are subjected to the children’s benefit. There is no valid ground behind the notification of the government as the parents and the teachers are not having any sort of objection. The high court further stated that its interim order is not absolute. In case any parent has objection in opposition to this, the honorable school authorities may also defer the decision laid by the Kerala High court[1].

The Kerala CBSE School Management Association (petitioners) cited the case of I.S.S. (English Medium) Senior Secondary School, Perinthalmanna v. State of Kerala & Ors. (2018). In this case, the high court had favored the commencement of the vacation classes through the approval of the parents and the teachers of the children above 14 years of age[2]. The impugned order of the Kerala government was having no valid grounds, the court observed.

The government on the other side, represented itself by the statement that due to the ongoing weather conditions, the emergence of the holidays proved to be fair. Moreover, the children can also able to spare some good time in the tenure of the vacations.

Hence, the order of the government instructing the holidays of children above 14 years got stayed by the Kerala high court. Furthermore, the court instructed the petitioners to ensure the uplift of their facilities by providing requisite number of fans to the students with proper drinking water in response to the current weather condition[3]. The final judgment of the high court would be updated after the detailed hearings of the concerned parties.
