On 28th March,2023 Andhra Pradesh High Court passed an order quashing a case of abetment to suicide U/S 306 IPC,1860 in the case of Gadipudi Anitha Vs. State of Andhra Pradesh.
The petitioners were creditors of the deceased, who in her suicide note has mentioned their names along with other creditors alleging them for harassment which lead to her commitment of suicide.
The court emphasized upon the definition of abetment of an act U/S 107 IPC where clause 3 states “ Intentionally aids, by any act or illegal omission.”.and here no actions of the petitioner was justified to be read with any clauses of 107 IPC , which defines the abetment.
Therefore, Justice R Raghunandan Rao referred to C.B.I Vs V.C.Shukla and stated as the petitioner was neither in any form related in aiding the suicide nor the intention behind the abetment was proved.
So, the abetment of suicide case before the Guntur District Court was quashed by the Andhra Pradesh High Court.
