In a significant development, the Madras High Court, on Monday, issued a verdict in a case involving the termination of a bus conductor employed by the Tamil Nadu State Transport Corporation (TNSTC). The conductor, A Ayyanar, was dismissed from service in 2015 based on allegations of failing to issue a ticket to a female passenger and possessing an excess of Rs.7 in the amount collected from passengers.[1]
The petitioner approached the High Court seeking to quash the termination order and reinstate his job with benefits. He argued that he had issued tickets to all passengers on the day in question and suggested that the woman had lost her ticket and falsely accused him.
The TNSTC argued that Ayyanar had caused financial loss to the corporation and failed to fulfil his responsibilities as an employee.
Justice PB Balaji critically evaluated the charges and found that the penalty imposed by TNSTC was “grossly disproportionate”. Furthermore, he highlighted that an excess of Rs.7 couldn’t be considered as an act causing loss to the corporation and expressed surprise at the severe penalty for such a minor charge. He also emphasized that no malice or malafide intent could be attributed in such cases. The Court, therefore, quashed the termination order and directed TNSTC to reinstate Ayyanar within six weeks, will all back wages and attendant benefits.[2]
The ruling reflects the emphasis on proportionality in disciplinary actions and the need for fair treatment of employees within governmental entities. It also underscores the importance of considering individual circumstances while determining appropriate punishments in cases of alleged workplace misconduct. It serves as a reminder to employers to assess the severity of charges and ensure that the penalties are proportionate to the alleged offences.
