The Jammu and Kashmir and Ladakh High Court as of late remained the police examination against previous Part Regulative Gathering (MLA) Shoaib Solitary in an assault case stopped by a lady who professed to be his significant other [Shoiab Solitary v Association Domain of J&K].
The investigation, with the exception of the recording of the victim’s statement, would be stayed, according to Justice Rajnesh Oswal.
The order read, “Subject to objections and until the next date of hearing before the bench, the investigation shall stay except to the extent of recording the prosecutrix’s statement.”
A plea to quake a First Information Report (FIR) filed under Sections 376 (rape), 342 (wrongful confinement), and 506 (criminal intimidation) of the India Penal Code was being heard by the Court.
A woman who claimed to be Shoiab Lone’s wife filed the FIR at the Baramulla Police Station in response to the complaint.
Solitary’s guidance contended that the FIR had just been stopped to pester the previous official.
Then again, government counsel Jahangir Ahmad Dar looked for time to document nitty gritty reaction while presenting that the complainant was over and over mentioned by the police to show up for recording of her assertion yet she didn’t turn up.
As a result, the case was moved to June 14 and the investigation was halted.
Additionally, the court sent notice to the complainant requesting a response.
