Inter Faith Couple- SC granted the bail

There was a Hindu girl who fall in love with a Muslim man, and they decided to got married,, but the family of the girl objected for the same. After the rejection from the family they ran away and started to living together with an live-in-agreement. They have entered into live in relationship agreement on dated 25.08.2022. And on the very next day he father of the girl filed a missing persons report. Out of the fear couple asked for the police protection anticipating a threat from the family, and moved to the HC for the same. The court grants the protection to the couple. After that the family found her and took her away forcefully and filed a FIR against the man under sections 366,376,384,323,328,120- B of Indian Penal Code and Section 3/4 of the POCSO Act. He pled for the bail before the subordinate court as well as the high court but got rejected.

The man argued that there were no grounds for rejecting his bail, as there was no evidence to proof that he had forcefully had intercourse with the girl. They do not have CCTV footage of the Hotel Bani Thani, where they alleged the event took place.

Finally the two judge bench consists of Justice Sanjay Kishan Kaul and Justice Sudhanshu Dhulia granted the bail to the man.
