Recently, the Goods, service, and Tax (GST) Council announced to levied 28% of tax on online gaming, casinos, and horse racing. And the council further added that for the purpose of recovering past tax demands, the government will appeal all instances to the Supreme Court.
The GST council said that the current GST rate paid by the online gaming sector is merely 2–3%, which is even lower than the 5% tax levied on everyday consumer goods like food.
Due to the addiction to online gaming applications, the majority of these gaming applications are Chinese and drain a significant amount of money from the Indian economy. The only problem is achieving the right balance to encourage the gaming industry’s continued expansion.
The Council decided that “games of skill” and “games of chance”[1] should not be distinguished from one another.
The policy is being criticized by experts in the industry, who label it a “self-goal” that would “kill” India’s skilled online gaming sector.[2]
The finance minister Nirmala Sita Raman said that, in classifying games as part of the online gaming category, the GST Council would closely collaborate with the IT ministry. Also, the online gaming sector was subject to 28% GST. Regarding the 28% GST, he stated that the choice to impose a tax was decided after thinking about the ethical dilemma presented by favouring online gambling above necessities that have long been subject to the GST.
“Our intention is not to end online gaming, casino, or horse racing. but all these have become so complex that go this route or go that route, each route has transparency to a certain extent, but after that, it is opaque.” [3]She further added that.
The unhappy gaming industry reacts to that decision “We consider the GST Council’s decision to be outrageous, irrational, and unconstitutional.”
