[i]In vikram rubal v. delhi police , the court held that there is growing tendency among women to rope in all relatives of husband including minors in matrimonial cases for the offence of cruelty under sec 498A of IPC.
In this case a man’s appointment as a subinspector in delhi police was kept in abeyance despite fulfilling all the condition of appointement just because he was named in an FIR filed by her sister in law against her husband and all her relatives including him.
The court noted that his name was mentioned in column 12 and there was no evidence of his involvement in any of the offences alleged .merely being named in an FIR is not a valid ground for keeping the appointment in abeyance unless the involvement is substantiated ,especially in matrimonial offences .thus the court ordered for his appointement.
There is growing tendency among women to include all the relatives in FIR irrespective of their involvement . many of such cases are then settled between the spouses and then later on stated to be filed in heat of passion .the abuse of aforesaid provision has been noticed and cannot be ignored in any manner.
