DELHI HIGH COURT PASSES UNIQUE ‘DYNAMIC+ INJUNCTION’ TO CURB ILLEGAL STREAMING OF EXISTING AND FUTURE CONTENT OF 6 STUDIOS

In the case of, Universal City Studios LLC & Ors Vs. DotMovies.Baby & Others, the Delhi High Court restrained all the 16 rogue websites and their redirects its variations from streaming or making available for downloading the existing and future content from six American studios. The bench of the single judge named Justice Prathiba Singh said that the studios can issue to keep pace with the dynamic nature of infringement.

There are some websites like Netflix Studios, Disney Enterprises, etc., which had been approached by the High Court. They all stated that all those rogue websites were permitting the viewing, streaming, etc., of their copyrighted content without any license or authorization in this. The Court said that these websites were newer versions of rogue websites which were injected in other cases like these.

These websites were asking viewers to suggest more content that they can upload and were also asking people to join platforms like Telegram to support sharing of content. The court held that these websites have the potential to create copyrighted content and can hurt the creation industry. The Court also said that there is an imminent need to evolve a global consensus to protect copyright owners. 

The Court underlined that there is an immediate need to evolve on a global basis to protect copyright owners instead of Internet Service Providers blocking these websites which can be accessed through VPN servers. The Court said that technology innovation continues remedies to be granted by courts. The court also clarified that an injunction order may concern the future works which cannot be granted in every case. Therefore, the court passed the interim order of injunction restraining the rogue websites from streaming on a daily basis.
