In the case of, Super Cassettes Industries Pvt. Ltd. v. Goldmines Telefilms Pvt. Ltd., the Delhi High Court directed that the production house Goldmines Telefilms cannot upload songs on YouTube from those 14 Bollywood movies for whom the T-Series has claimed copyright. The world’s largest music-producing company i.e., T-Series with 247 million subscribers on YouTube, and after that Goldmines is also a large company for production and dubbing business and has 87.7 million subscribers.
On 1st August 2023, Justice Prathiba M. Singh passed the order after hearing the T-Series suit which wants to restrain Goldmines from uploading songs from 14 Bollywood movies like Vaastav, Diljale, Guru, etc. After considering the nature of the disputes the defendant shall not upload any further audio or audio-visual works from the matter of disputed films, and they have already been uploaded on YouTube, till the next date of hearing of the case.
The T-Series argued that the Goldmines does not have the right to authorize the uploading of those movie songs on YouTube. After that, they have taken down some of the videos and but many songs continued to remain on the Goldmines channel. Then, the Goldmines argued that they got the assignment of rights in which cinematograph films from the movie’s producers linked them and, they were entitled to exploit the songs as well.
The Petitioner countered by saying that the assignments of audio-visual works were in the prior time which was prescribed. Therefore, the producers do not have the right to assign the Goldmines rights which already have been assigned to T-Series. Afterward, the Bench said that they will consider whether Goldmines has the right to exploit the audio-visual songs or not. The Court issued the interim injunction against the Goldmines and asked them to file their reply to the court.
