
The Delhi high court agreed to hear the plea with seeked disclosure of UPSC preliminary examination answer key.
The matter related to unsuccessful UPSC aspirants who filed a plea to quash this exam but the court refused to stay UPSC’s invitation for applications for its MAINS examination, 2023.
In this case, the UPSC contended that the plea is not maintainable because the recruitment and employment matters are dealt by CAT (central administrative tribunal). But the court opined that the matters relating to a person’s fundamental rights can always be heard and In this case, it concerned right of fair play, legitimate expectations and right to know .
Justice Chandra Dhari Singh also observed that publishing an answer key is not an interference in “recruitment” of civil servants so the exclusive jurisdiction of CAT can’t be invoked.
The upsc in a circular issued the notice that the answer key would be published after whole process of exams is completed.
This was challenged as candidates need answer keys to access their performances and all the examinations of IIT’s and IIM’s publish their answer key in around a week after exam.
The detailed order is still pending.
The petition was filed by 17 UPSC aspirants and were represented by advocate Saurav Agarwal, Rajeev Kumar Dubey, Ashish Tiwari and Sahib Patel.
