At the 60th Convocation Ceremony of the Indian Institute of Technology (IIT) Madras, Chief Justice of India (CJI) DY Chandrachud raised concerns about the potential risks and challenges posed by Artificial Intelligence (AI). While acknowledging the growing popularity and utility of AI, the CJI emphasized that it could also be used as a tool to perpetuate discrimination and undermine the right to fair treatment.[1]
The CJI cited the example of AI recruitment tools used by companies that exhibited biased decision-making, preferring male candidates over female candidates. Such biased data inputs can perpetuate societal prejudices and hinder equal opportunities.
Highlighting the dual nature of AI, the CJI acknowledged the significant progress made in AI technology, but he also cautioned about its potential misuse. AI-generated content, while fascinating and capable of great advancements, also carries the risk of producing deceptive and harmful content, including fake images, misinformation, and threats.
Expressing concern about the potential consequences of AI on individuals and society, the CJI stressed that technology should not create fear among users about online abuse or harassment. This fear can directly impact individuals’ ability to freely express their thoughts and opinions.
Addressing the IIT Madras graduates, the CJI reflected on the principled values that technology represents. He underscored the dynamic relationship between technology and the law, citing examples from history where law played a vital role in managing risks associated with technological advancements.
The pandemic-induced virtual court hearings shed light on the difficulties faced by female lawyers due to gendered demands of domestic responsibilities. The adoption of video-conferencing technology during court proceedings helped improve inclusivity and access to justice, providing female lawyers with opportunities to argue from home.
The CJI also raised concerns about surveillance through technology, emphasizing the importance of privacy and confidentiality. He highlighted the need for technology and law to strive towards achieving these basic requirements while addressing new technological affordances.
Moreover, the CJI noted the significant impact of social media and the internet on the marketplace of ideas. While facilitating communication and collaboration, these platforms have also given rise to negative behaviors like online abuse and trolling. As technology evolves, the law must anticipate and address the negative consequences that arise from these new developments to safeguard individual rights.
The CJI’s speech at the IIT Madras Convocation highlighted the need for responsible and ethical deployment of AI and other technologies. While recognizing the tremendous potential of AI, he called for a careful examination of its impact on individuals, society, and the legal framework to ensure that technology serves humanity positively and responsibly.
