The matter of challenging the 75 percent criteria provision was initially set up on 1st March 2023. Eventually, on 3rd May 2023, the Bombay High Court finally released its verdict favoring the refusal of the proposal to abolish this policy from the JEE Mains, 2023. The bench held that the outlook for such policy frame resides within the power of government and therefore the court would not be obliged to issue the writ of mandamus to the government. However, the court earlier had instructed the National Testing Agency to showcase all the documents backing this eligibility criterion. Hence, the NTA framed the Affidavit in which it mentioned all the reasonable grounds behind the practice of the 75 percent eligibility rule. Furthermore, the court stated that the removal of such policy was deemed crucial in the past few years as they belong to the age of COVID-19. The same cannot be executed presently.
The petitioners held that many students below 75% may be able to contribute their best performance in JEE, 2023. While on the other side, the additional solicitor general Anil Singh and counsel Ruli Rodrigues presented the fact that students were well aware of such policy and getting themselves prepared according to that policy1. They also believed that abolition of this provision from the entrance exam would disturb the action plan of the aspirants as they were assumed according to the concerned eligibility criteria. NTA has already conducted its JEE Mains, 2023 successfully, now they are ready to prepare for the conduct of JEE Advanced. Hence, they would not be able to change their criteria. The petition also demanded the postponement of the JEE Mains, 2023 but got rejected by the Bombay High Court2.
