Baring lawyer’s enrollment with the bar council of India for non-resident of Delhi is inappropriate – Delhi High Court

The Delhi High Court has made remarks criticizing the Bar Council of Delhi’s (BCD) notification, which requires Aadhar and Voter Identity Cards with Delhi-NCR addresses for enrollment with the BCD. The court stated that this notification should be struck down immediately.

Justice Subramonium Prasad questioned the BCD about how it can restrict individuals who are not residents of Delhi from seeking enrollment. The court emphasized that the BCD membership should not be limited to Delhi residents and that the notification is unjust.

The court further acknowledged that Delhi is a favorable place for practicing law, and people from various locations come to the capital for this purpose. Justice Prasad highlighted the predicament faced by individuals living outside Delhi who wish to practice law there to support themselves.

The plea challenging the BCD’s notification was filed by advocate Shannu Baghel, who argued that the notification is discriminatory as it prevents individuals from outside Delhi-NCR from enrolling and practicing law in Delhi.

The court has scheduled Baghel’s plea for further hearing in August, along with other cases challenging the same notification.
