APPEAL FILED IN SUPREME COURT AGAINST PATNA HIGH COURT VERDICT UPHOLDING BIHAR CASTE SURVEY

The survey was conducted by the General Administration Department of the Bihar Government, where the caste of the people living in the area was reviewed and the survey was conducted on 7th January 2023. But, due to many comments made by the general public on 1st August, an order was passed by the High Court of Patna where it was declared that the survey was conducted for the betterment of the individual and to label them into groups.

This survey was conducted in 2 ways where the household survey was conducted on January 2023 whereas another was conducted on 15th April where the survey was conducted on a socio-economic basis. Whereas, further proceedings are scheduled in May of the current year 2023. The High Court of Patna on overviewing the order of the state legislation that the caste survey was performed ambiguously and with the motive of giving justice to the public.

Chief Justices K. Vinod Chandran and Partha Sarthy viewed that in its 1st August judgment of state authority that the caste status is above all differentiating the people based on caste but identifying the people with the educational, social, and other capabilities. No right to privacy is being infringed here. In May proceedings the 3 petitions were filed and it was rectified that the survey can be conducted by the central government itself.

The Bihar Government moved to the Supreme Court against the High Court of Patna’s order on stay. Where the Supreme Court rejected to lift the interim stay, and told the state govt. to communicate with the High Court of Patna. The matter then was heard by the division bench which proceeded to dismiss the challenge on 1st August.
