ALLAHABAD HIGH COURT REFUSES TO QUSH CASE AGINST MAN ACCUSED OF SHARING DISRESPECTFUL IMAGE OF LORD HANUMAN.

In RAJESH KUMAR VS. STATE where rajesh kumar was applicant nd state of up and another was opponent party , was leaded by justice HONERABLE PRASHANT KUMAR, J

 In this case  a man share a highly objectional photo of lord hanuman jii accompanied by an offensive caption. The  Allahabad high court refused to quash case against the accused, because the PRIME FACIE had been against the accused.

The court noted that the  picture shared by accused was highly objectional and shameless , so that a chargesheet had also been filed.

While the accused  moved  a plea under section 482 of CRPC   before the  high court to quash the case.

The court relied on the supreme court’s judgement in STATE OF HARYANA VS. BHJAN LAL and  KAPTAN SINGH VS. SATE OF UTTAR PRADESH wherein court had established guildlines regarding power by high court ‘s power to quash cases under section 482 ,CrPC.
